What Is Family Law?

What is Family Law?

Family Law is an area of legal practice that focuses on family relationships. You will work with a family law attorney in the case of divorce, child custody or visitation rights, adoption, emancipation or paternity.

The most common cases seen in family law consist of:

  • Divorce

  • Child Custody

  • Adoption

Divorce

In the case of a divorce, both parties involved in the divorce will hire their own family law attorney. The family law attorney will assist in the negotiations of a settlement plan in the hopes of avoiding a trial.

Many family law attorneys, like Daniel Willems, use alternative dispute resolution tactics, such as Mediation, to reduce the emotional burden of divorce.

The final divorce settlement will typically include provisions for child custody, child support, spousal support and property division.

Child Custody

As stated above, many times child custody is addressed in the divorce case. However, if one party wishes to revisit the current child custody plan or there is a significant change in circumstances for one or both parties, child custody can be revisited.

Your family law attorney will work with you and the other party’s counsel to arrive at the best plan for the child(ren)’s well-being.

Adoption

Adoption is a very long and complicated process. Your family law attorney will be there to help you through the many steps and procedures needed for your adoption.

Each adoption differs based on the type of adoption, your circumstances, the state or country the child is from and more. Working with a family law attorney will ensure that your adoption goes as smoothly and quickly as possible.

Work with a Family Law Attorney

If you are currently or will soon be going through any of the above situations, working with a family law attorney can help reduce stress and drastically improve the probability of a positive outcome for you and your family.
